Can You Sue For Defamation of Character in Nashville, Tennessee?

Yes. Tennessee recognizes defamation as a civil cause of action, and both individuals and businesses can sue when a false statement of fact causes reputational harm. Tennessee defamation law is largely common law, shaped by court decisions rather than a single comprehensive statute. To bring a successful defamation claim under Tennessee law, a plaintiff must show:

  • The defendant published a false statement of fact about the plaintiff
  • The statement was communicated to a third party
  • The defendant acted with at least negligence as to the truth of the statement
  • The plaintiff suffered actual damage to their character or reputation

Private individuals must generally show the defendant acted with negligence. Public officials and public figures must prove “actual malice” by clear and convincing evidence, meaning the defendant knew the statement was false or acted with reckless disregard for the truth.

Importantly, Tennessee no longer recognizes presumed damages, even in cases that would historically have been considered defamation per se. That means a Nashville plaintiff is required to prove actual injury, whether to reputation, business, profession, or emotional well-being, in every defamation case.

Tennessee’s Two Different Statutes of Limitations

Tennessee is unusual in that it applies two different filing deadlines depending on whether the statement was written or spoken:

  • Slander (spoken defamation): six months from when the words were uttered, under Tenn. Code Ann. § 28-3-103

The slander deadline is one of the shortest in the country, and Tennessee courts generally do not apply the discovery rule to extend it. If someone is spreading false statements about you verbally, even in private conversations or recorded calls, you have a very short runway to act.
