Once our paralegals have reviewed your legal issue and determined we are the right fit for your matter, we will contact you within 24 to 48 business hours to schedule your free, initial no-obligation online harassment consultation.

Depending on your online matter, it is entirely possible that you do not need to speak with an attorney at all. For example, Minc Law paralegals handle all Guaranteed Content Removals.

Every situation is unique. We offer two primary types of services and pricing that we charge clients for all of our firm’s online stalking and internet harassment engagements. These are:

Hourly Non-Litigation Services

Hourly Non-Litigation Services is when a client retains our firm where no litigation is contemplated or involved as part of the legal engagement. These services generally involve the removal of news articles, blogs, consumer reviews, images, court pleadings, and other content that is typically either factual in nature or otherwise not actionable. However, they can involve almost anything, including, online harassment, cease and desist letters, extortion, sextortion, criminal conduct, pornography, revenge pornography, defamation, and other online privacy concerns.

Most Hourly Non-Litigation Services do not qualify as Guaranteed Removal Services and require an upfront retainer of $3,500$4,500.

The average cost of most Hourly Non-Litigation Services typically falls between $5,000$6,000. However, total costs will vary considerably based on a variety of factors. 

Litigation Services  

~ ($7,500 – $16,000)

Litigation Services are appropriate when a client’s case involves filing in a lawsuit (or other types of involvement in litigation). We bill litigation services hourly, including expert witness services. Generally, we require a minimum retainer of $7500 for any litigation matter. Average total costs can go as low as $5,000$7,500, but on average fall between $14,000$16,000 for most of the matters we handle. Total cost of your litigation matter will be influenced by a number of important factors.

When Does Online Stalking & Internet Harassment Cross the Line Into Criminal Conduct?

Cyberstalking and internet harassment are both crimes in the United States. However, the legal code leaves much to be desired and fails to properly differentiate between several differing crimes; cyberstalking, online harassment, and cyberbullying. The core federal anti-cyberstalking law which is most often applied and cited is 47 U.S. Code § 223, which reads:

“(1) Whoever, in interstate or foreign communications, by means of a telecommunications device knowingly, makes, creates, or solicits, and initiates the transmission of, any comment, request, suggestion, proposal, image, or other communication which is obscene or child pornography, with intent to abuse, threaten, or harass another person…”

Present-day cyberstalking actions are usually criminalized under U.S. anti-harassment, anti-stalking, and surprisingly, slander statutes and laws.

Unfortunately, there is a lack of comprehensive cyberstalking and internet harassment legislation at the federal level, which leaves enforcement in the hands of your state. Can a Minc Law Attorney Represent Me Even If I’m Located in a Different State?

Of course!

For both Non-Litigation and Guaranteed Removal Internet Defamation Matters, your location will not be an issue at all. Not being licensed or located in your state is no way a hurdle or impediment to Minc Law being able to represent you, provide legal services, and get results.

If you have a Litigation Matter, we are still able to represent you. But, if none of our attorneys are licensed in your state, or we have to file something outside of the United States, we will have to work with local counsel who is licensed in your state. This type of arrangement is something we do in almost all of our Litigation Matters.

How Should I Protect Myself Against Online Stalking & Internet Harassment?
To protect yourself against cyberstalking and online harassment, we recommend the following:

  • Make sure to preserve and document all evidence – this will ultimately help strengthen your claim,
  • Install an email and content filtering system – as targeted phishing and malware schemes are common ways by which cyberstalkers and online harassers access personal information,
  • Don’t respond or retaliate – doing so could actually do more harm than good, and lead to the further dissemination of personal information/photographs and increased harassment,
  • Understand what actually constitutes cyberstalking and its various defenses – acquainting yourself with a perpetrator’s common defenses could lead to you realizing there is no actionable cyberstalking or online harassment claim, and
  • Consider tightening up your digital footprint and public online profiles – the less personal information that’s out there, the lesser chance of having personal information and photographs used against you.
